Staff matters between COMESA and institutions leads in the number of cases that the Court of Justice has determined followed by disputes between the private sector and governments. A total of 26 staff matters were determined by the Court in its mandate to ensure that COMESA remains a Rule based Organisation which contributes effectively towards Economic Integration and increasing Stake holders’ confidence in dispute resolution.

Five disputes were determined between the private sector and government and four each amongst private sector institutions, between COMESA institutions and between the institutions and government. Three cases were determined between governments.

In a report presented to the Intergovernmental Committee, the Court noted that there was tremendous potential for increased litigation regarding breaches arising out of the establishment of Free Trade Area provisions and the establishment of a Customs Union.

Decisions of the COMESA Court of Justice are decisive in informing about the interpretations of decisions, directive, regulations (and rule) and COMESA instruments. The Court’s decisions have significant implications in particular for Member States and the COMESA Secretariat.
